General Terms and Conditions of Sale for Online Purchases on Nutrifarma.it

1. GENERAL NOTES

These general conditions, unless otherwise expressly agreed in writing between the parties, govern all contracts between AQUAVIVA ITALIA S.R.L., headquartered at Via Ausa no. 117, 47853 Coriano (RN) (hereinafter also referred to as the "Distributor Company" or "Seller Company") and the final consumer. AQUAVIVA ITALIA S.R.L. markets the Nutrifarma brand online through the website nutrifarma.it, for which this contract is drafted.

2. OBJECT

These general conditions govern the purchase contracts of the materials marketed by AQUAVIVA ITALIA S.R.L. (hereinafter referred to as "Products") concluded between AQUAVIVA ITALIA S.R.L. and the Final User. The materials marketed by the Distributor Company include sports supplements and other related products of the Nutrifarma brand, sold through the website nutrifarma.it.

3. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The Customer, by sending a confirmation email of their purchase order, unconditionally accepts and agrees to observe in their relations with AQUAVIVA ITALIA S.R.L. the general conditions of sale and payment indicated in this contract, declaring to have read and accepted all the indications provided. AQUAVIVA ITALIA S.R.L. is not bound by different conditions unless previously agreed in writing.

4. ORDERS

Orders are placed online by selecting the desired products on the website nutrifarma.it. The contract is finalized upon confirmation of the order by AQUAVIVA ITALIA S.R.L., relating to the chosen products.

5. PRICES

All prices of the items in the AQUAVIVA ITALIA S.R.L. catalog on nutrifarma.it include taxes and constitute the final price to the customer, excluding transport costs. Prices are per single piece, as specified in the online catalog.

6. WARRANTY

The products covered by the contract are guaranteed to comply with the specifications reported in the product sheets and consistent with the international regulations currently in force. Any complaints must be reported by registered mail to the seller company AQUAVIVA ITALIA S.R.L. at the legal headquarters in Via Ausa no. 117, 47853 Coriano (RN), within the legal terms.

7. PAYMENTS

Payments must be made exclusively by credit card or other payment methods allowed by the website nutrifarma.it. The purchased products will be sent only upon confirmation of payment. AQUAVIVA ITALIA S.R.L. is not responsible for any fraudulent and illegal use of credit cards by third parties during the payment of purchased products. AQUAVIVA ITALIA S.R.L. is unable to know the buyer's credit card number at any point in the purchase process, which is managed through the interface of a financial intermediation service provider.

8. PRIVACY

Pursuant to the current privacy regulations of the Republic of San Marino, the final user declares to be aware and approve that the data provided are entered into the "Customer Database of AQUAVIVA ITALIA S.R.L." and can be used for promotional, commercial, and sales purposes, as well as for statistics through consultation, processing, or comparison, or for the sending of editorial and/or promotional material. The final user also declares to authorize AQUAVIVA ITALIA S.R.L. to communicate and/or disseminate the data provided and entered into the Database to other companies, provided for the same purposes for which they were collected. The interested party expressly and freely enjoys the rights established by community regulations, such as requesting and obtaining the updating, rectification, integration, or cancellation of their data.

9. SERVICE DISRUPTIONS

AQUAVIVA ITALIA S.R.L. assumes no responsibility for service disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the sales agreement within the agreed times. The Seller Company will not be liable to any party for damages, losses, and costs incurred as a result of the non-fulfillment of the sales agreement due to the above causes.

10. RIGHT OF WITHDRAWAL

In the case where a purchase contract is concluded outside commercial premises, such sale is subject to Directive 85/577/EEC and the current regulations of the Republic of San Marino, which provide the buyer with the possibility of exercising the right of withdrawal. This includes purchases made via the Internet by the Final User, excluding authorized resellers and companies. To exercise the right of withdrawal, the Customer must communicate to the seller company within 10 days of receiving the goods, by registered letter with return receipt, or by telegram, sent within the same period and confirmed by registered letter with acknowledgment of receipt within the next forty-eight hours, their decision - even if unmotivated - to exercise the right of withdrawal, indicating name, surname, address, telephone number, copy of the purchase document, and order number. Also within the tenth day, the Final User must return to AQUAVIVA ITALIA S.R.L. the products subject to withdrawal, in perfect condition, in the original packaging, and complete with all accessories provided at the time of purchase, together with the purchase document. Shipping costs are borne by the Final User. Within 30 days of receiving the returned product, AQUAVIVA ITALIA S.R.L. will credit the buyer with the amount paid, less only the ancillary costs (delivery charges and any cash on delivery fees).

11. DELIVERY

The delivery of the ordered products will take place at the place indicated by the Final User within a period not exceeding three weeks from the receipt of the order by the seller company. AQUAVIVA ITALIA S.R.L. can in no way be held responsible for any delays or failure to fulfill orders due to chance or force majeure, nor for delays attributable to the goods carrier. The Distributor Company reserves the right to fulfill orders even partially and to invoice the individual deliveries. Any complaints due to errors or inaccuracies must be received by AQUAVIVA ITALIA S.R.L. by written communication within 8 days of receiving the goods.

12. TRANSPORT

The transport of purchased products will take place via international courier. The goods travel at the buyer's risk. It is necessary to check immediately upon delivery for any damage or loss, noting it on the carrier's documentation and notifying AQUAVIVA ITALIA S.R.L. by email. The goods and packaging must be kept available for further inspections. Transport costs are borne by the Final User as indicated in the tables displayed on the site.

13. RETURNS

In case of return of purchased goods, shipping costs are borne by the Final User. Within 30 days of receiving the returned product, AQUAVIVA ITALIA S.R.L. will credit the buyer with the amount paid, less only the ancillary costs (delivery charges and any cash on delivery fees).

14. DISPUTES

In case of disputes, the parties reserve the right to access the competent judicial authorities for the territory of the Republic of San Marino. Any disputes will be resolved according to the law of the Republic of San Marino.
