Terms of service
1. GENERAL NOTES
These general conditions, unless otherwise expressly agreed in writing between the parties, govern all contracts between the company AQUAVIVA ITALIA S.R.L. with headquarters in Via Ausa n.117, 47853 Coriano (RN) (hereinafter also referred to as the "Distribution Company" or "Selling Company") and the final Consumer. AQUAVIVA ITALIA S.R.L. markets the Nutrifarma brand online through the nutrifarma.it website, for which this contract is drawn up.
2. SUBJECT
These general conditions govern the purchase contracts for materials marketed by the company AQUAVIVA ITALIA S.R.L. (hereinafter referred to as "Products") concluded between AQUAVIVA ITALIA S.R.L. and the End User. The materials marketed by the Distribution Company include sports supplements and other related products under the Nutrifarma brand, sold through the nutrifarma.it website.
3. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
By sending an email confirming your purchase order, the Customer unconditionally accepts and undertakes to observe these conditions in his/her dealings with AQUAVIVA ITALIA. S.R.Lthe general conditions of sale and payment indicated in this contract, declaring that you have read and accepted all the information provided. AQUAVIVA ITALIA S.R.L. does not consider itself bound by different conditions unless previously agreed in writing.
4. ORDERS
Orders are placed online by selecting the desired products on the nutrifarma.it website. The contract is concluded upon confirmation of the order by AQUAVIVA ITALIA. S.R.L., relating to the selected products.
5. PRICES
All prices of items in the AQUAVIVA ITALIA catalogue S.R.L. on nutrifarma.it include taxes and represent the final price to the customer, excluding shipping costs. Prices are per item, as specified in the online catalog.
6. WARRANTY
The products covered by the contract are guaranteed to comply with the specifications reported in the product data sheets and with current international regulations. Any complaints must be reported by registered mail with return receipt to the seller, AQUAVIVA ITALIA. S.R.Lat the registered office in Via Ausa n.117, 47853 Coriano (RN), within the legal deadlines.
7. PAYMENTS
Payments must be made exclusively by credit card or other payment methods supported by nutrifarma.it. Purchased products will be shipped only after payment has been confirmed. AQUAVIVA ITALIA S.R.L. is not responsible for any fraudulent or illicit use of credit cards by third parties during payment for purchased products. AQUAVIVA ITALIA S.R.L. is not able to know the Buyer's credit card number at any point during the purchase process, which is managed through the interface of a financial intermediation service provider.
8. PRIVACY
Pursuant to the current privacy legislation of the Republic of San Marino, the End User declares to know and approve that the data provided will be entered into the "AQUAVIVA ITALIA Customer Database". S.R.L.” and may be used for promotional, commercial, and sales purposes, as well as for statistical purposes through consultation, processing, or comparison, or for sending editorial and/or promotional material. The End User also declares that he/she authorizes AQUAVIVA ITALIA S.R.Lto communicate and/or disseminate the data provided by him/her and entered into the Database to other companies, provided that this is done for the same purposes for which it was collected. The interested party expressly and freely enjoys the rights established by EU legislation, such as requesting and obtaining the updating, rectification, integration, or deletion of his/her data.
9. DISTURBANCES
AQUAVIVA ITALIA S.R.Lassumes no responsibility for disruptions attributable to force majeure, such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the sales agreement within the agreed timeframe. The Selling Company shall not be liable to any party for damages, losses, and costs incurred as a result of the failure to execute the sales agreement for the reasons mentioned above.
10. RIGHT OF WITHDRAWAL
In the event that a purchase contract is concluded away from business premises, such sale is subject to Directive No. 85/577 EEC and the applicable legislation of the Republic of San Marino, which provides for the purchaser's right of withdrawal. This also includes online purchases made by the End User, excluding authorized retailers and companies. To exercise the right of withdrawal, the Customer must notify the seller within 10 days of receiving the goods, by registered mail with return receipt, or by telegram sent within the same period and confirmed by registered mail with return receipt within the following forty-eight hours, of their decision—even without a reason—to exercise the right of withdrawal, indicating their name, surname, address, telephone number, a copy of the purchase document, and the order number. Always within the tenth day, the End User must return to AQUAVIVA ITALIA S.R.LThe returned products must be in perfect condition, in their original packaging, and complete with all accessories supplied at the time of purchase, along with the purchase receipt. Shipping costs are the responsibility of the End User. Within 30 days of receiving the returned product, AQUAVIVA ITALIA S.R.L. will credit the buyer with the amount paid, minus only any additional costs (delivery costs and any cash on delivery fee).
11. DELIVERY
The ordered products will be delivered to the location indicated by the End User within a period not exceeding three weeks from the seller's receipt of the order. AQUAVIVA ITALIA S.R.Lcannot be held responsible under any circumstances for any delays or failure to fulfill orders due to unforeseeable circumstances or force majeure, nor for delays attributable to the carrier. The Distribution Company reserves the right to fulfill orders even partially and to invoice individual deliveries. Any complaints due to errors or inaccuracies must be addressed to AQUAVIVA ITALIA. S.R.L. by written communication within 8 days of receiving the goods.
12. TRANSPORT
The purchased products will be shipped via international courier. The goods travel at the buyer's risk. It is necessary to inspect them immediately upon delivery for any damage or loss, reporting them on the carrier's documentation and notifying AQUAVIVA ITALIA via email. S.R.LThe goods and packaging must be retained for further inspection. Shipping costs are the responsibility of the End User, as indicated in the tables on the website.
13. RESI
In the event of a return of purchased goods, shipping costs are the responsibility of the end user. Within 30 days of receiving the returned product, AQUAVIVA ITALIA S.R.L. will credit the buyer with the amount paid, minus only any additional costs (delivery costs and any cash on delivery fee).
14. DISPUTES
In the event of any dispute, the parties reserve the right to seek legal action before the competent courts in the Republic of San Marino. Any disputes will be resolved in accordance with the laws of the Republic of San Marino.
